Agreement to Terms
By accessing and using the Destination Design Pools website and services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms and Conditions, please do not use our services.
Services
Destination Design Pools provides comprehensive outdoor living design and construction services, including but not limited to custom pools, spas, outdoor kitchens, sports courts, hardscapes, and complete backyard transformations. All services are subject to availability and final approval.
Consultations and Estimates
Free on-site consultations are provided to prospective clients. Estimates and project proposals are valid for 30 days from the date of issue. All estimates are subject to change based on site conditions, material availability, and project scope modifications.
Contracts and Payments
Upon acceptance of a proposal:
- A formal contract will be executed between Destination Design Pools and the client
- Payment schedules will be outlined in the contract
- A deposit is typically required to commence work
- Progress payments may be required at specified project milestones
- Final payment is due upon project completion and client approval
Project Timeline
Project timelines are estimates and may be affected by weather conditions, material availability, permitting delays, or unforeseen site conditions. We will make reasonable efforts to complete projects within the estimated timeline and will communicate any delays promptly.
Permits and Regulations
Destination Design Pools will assist in obtaining necessary permits and ensuring compliance with local building codes and regulations. The client is responsible for providing accurate property information and granting access for inspections as required by local authorities.
Changes and Modifications
Changes to the project scope after contract execution must be documented in writing and may result in additional costs and timeline adjustments. Change orders must be approved by both parties before work proceeds.
Warranties
We provide warranties on our workmanship and materials as outlined in individual contracts:
- Workmanship warranty terms will be specified in the contract
- Material warranties are provided by manufacturers
- Equipment warranties are subject to manufacturer terms
- Warranty claims must be reported promptly in writing
Limitation of Liability
Destination Design Pools shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the contract amount for the specific project.
Property Access and Safety
Clients must provide safe and reasonable access to the work site. We maintain appropriate insurance and follow safety protocols. The client is responsible for securing pets and ensuring the safety of household members during construction.
Intellectual Property
All designs, plans, and creative work produced by Destination Design Pools remain our intellectual property unless otherwise specified in the contract. Clients receive a license to use the designs for their specific project.
Photography and Marketing
We may request permission to photograph completed projects for portfolio and marketing purposes. Client consent will be obtained before using any project images publicly.
Dispute Resolution
Any disputes arising from our services will first be addressed through good-faith negotiation. If resolution cannot be reached, disputes may be submitted to mediation or arbitration as specified in the contract.
Termination
Either party may terminate the contract under conditions specified in the agreement. Termination terms, including payment for completed work and materials, will be outlined in the contract.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
